Conflicto de competencia suscitado entre el Juzgado Promiscuo Municipal de Sopó y el Juzgado Promiscuo Municipal de Tocancipá.

Teniendo en cuenta que al accionante eligió presentar la acción de tutela ante los jueces municipales de Sopó, considera la Corte que se debe respetar dicha elección, máxime cuando dichas autoridades resultan competentes para asumir el conocimiento del asunto.

Se ordena la remisión del expediente al Juzgado Promiscuo Municipal de esa entidad territorial, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

  1. Primero. DEJAR SIN EFECTOS el Auto del 14 de junio de 2017 proferido por el Juzgado Promiscuo Municipal de Sopó, dentro del expediente ICC-3026.
  2. Segundo. REMITIR al Juzgado Promiscuo Municipal de Sopó el expediente ICC-3026, para que, de manera inmediata tramite y adopte la decisión de fondo a que haya lugar, dentro de la acción de tutela presentada por Luis Alfredo Jiménez Avellaneda contra la empresa Ingetecho y Construcciones S.A.S.
  3. Tercero. ORDENAR que por Secretaría General se comunique la decisión adoptada en esta providencia a las partes y al Juzgado Promiscuo Municipal de Tocancipá.
